Terms of Service

1. Acceptance of these terms

By accessing or using Retouva, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

If you use Retouva for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

2. The service

Retouva uses artificial intelligence to restore, enhance, repair, and optionally colorize photos. Features, limits, supported formats, output resolution, processing time, and credit requirements may vary and are shown in the service.

Retouva is a creative and convenience tool. It is not an archival, forensic, identity-verification, or professional evidence service.

3. Accounts and eligibility

You must be at least 13 years old to use Retouva. If you are under the age of legal majority where you live, you may use the service only with permission from a parent or legal guardian.

You are responsible for activity under your account and for protecting access to your Google account and device. Account information must be accurate, and you must promptly notify us of suspected unauthorized access.

4. Your content

You retain your rights in photos you upload and, subject to third-party rights and applicable law, in the results generated for you. Retouva does not claim ownership of your uploaded photos.

You grant Retouva and its service providers a limited, worldwide license to host, copy, transmit, process, modify, and display your content only as reasonably necessary to operate, secure, and improve the service, fulfill your requests, and comply with law. This license ends when the content is deleted from active systems, subject to reasonable backup, cache, and legal-retention periods.

You represent that you own your content or have all permissions needed to upload and process it, including appropriate permission relating to identifiable people shown in a photo.

5. Acceptable use

You may not use Retouva to:

• violate any law or another person's privacy, publicity, intellectual-property, or other rights;
• process photos you are not authorized to use or create deceptive impersonations, forged evidence, fraud, harassment, or defamation;
• create or distribute sexual content involving minors, non-consensual intimate imagery, or content that exploits or endangers any person;
• upload malware or content designed to disrupt, overload, probe, or compromise the service;
• bypass usage limits, access controls, or security measures, including by manipulating browser identifiers or creating abusive accounts;
• reverse engineer or scrape the service except where such restriction is prohibited by law; or
• use Retouva in a way that could expose us, our providers, or other users to harm or liability.

6. AI-generated results

AI restoration may estimate or invent details where the original is blurred, damaged, hidden, or missing. Faces, text, colors, uniforms, jewelry, dates, and historical details may be inaccurate. Results can vary between attempts and may not meet your expectations.

You are responsible for reviewing results and deciding whether they are suitable for your intended use. Keep the original photo and do not present an AI-restored result as an exact historical or factual record. Do not rely on Retouva output for legal, medical, identity, law-enforcement, or other high-stakes decisions.

7. Credits, payments, and refunds

Some features require credits. Current prices, included credits, applicable taxes, and usage costs are displayed before purchase or use. Payments are processed by Stripe under its own terms. Credits have no cash value, cannot be transferred unless we expressly allow it, and may be used only with Retouva.

Contact [email protected] about duplicate charges, technical failures, or refund requests. Refund eligibility depends on the circumstances, the checkout terms presented to you, and applicable consumer law. Nothing in these terms limits rights that cannot legally be waived.

8. Availability and changes

We may add, change, limit, suspend, or discontinue features, models, providers, pricing, or usage limits. We do not guarantee that the service or any particular result will always be available, uninterrupted, secure, or error-free. Where practical, we will try to avoid materially reducing paid value without reasonable notice or an appropriate remedy.

9. Disclaimers

To the fullest extent permitted by law, Retouva is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant that results will be accurate, authentic, unique, or suitable for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, Retouva and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from use of the service.

Where liability cannot be excluded, our aggregate liability relating to the service will not exceed the greater of the amount you paid to Retouva during the six months before the event giving rise to the claim or US$50. These limitations do not apply where prohibited by law.

11. Suspension and termination

You may stop using Retouva at any time. We may limit, suspend, or terminate access when we reasonably believe you violated these terms, created risk or harm, failed to pay applicable charges, or when necessary to comply with law or protect the service. Provisions that by their nature should survive termination will remain in effect.

12. General terms

We may update these terms to reflect changes to Retouva, our providers, or applicable law. Updated terms will be posted here with a revised effective date. Continuing to use the service after updated terms take effect means you accept them.

If any provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets.
